Privacy Policy

Effective date and last updated: October 19, 2026

1. Who we are and how to contact us

Viva Design Co. provides creative, design, digital, technology, and marketing services. This policy explains how information is handled in connection with vivadesignco.com, inquiries, client intake, billing, service delivery, and transactional SMS communications when available.

For privacy questions or communication preferences, contact CustomerSupport@vivadesignco.com or +1 (505) 908-7053.

2. Information you provide

Our website contact forms request your name, email address, phone number, and message. When you contact us, complete client intake, or work with us, information may also include the business and project details, materials, communications, and account or invoice information you provide for that relationship.

Billing and payment management may involve invoice details, payment status, and transaction references. Payment information entered into a payment provider's interface is also subject to that provider's privacy notice and terms.

Please avoid sending passwords, full payment-card details, or other sensitive information through general inquiry forms. Additional information about a particular intake or service may be provided at the point of collection or in your client agreement.

3. Website technologies and cookies

The website uses Webflow for hosting and website forms. Google Analytics measures website use, Google Tag Manager manages measurement tags, and Meta Pixel supports advertising measurement. These technologies may process IP addresses, browser or device information, pages viewed, and interactions, and may use cookies or similar identifiers.

The website also loads Google-hosted fonts and reCAPTCHA resources. A Flowappz cookie-consent script is delivered through jsDelivr. These third-party resources may receive technical information when your browser connects to them.

You can use browser settings to manage or remove cookies. Blocking cookies or other resources may affect website features. Provider privacy information is available from Webflow, Google, and Meta.

4. How information is used

Information provided for a business relationship is used to respond to inquiries, understand project requirements, manage and deliver agreed services, administer invoices, communicate about accounts and projects, and provide support. Website measurement information is used to understand website activity and evaluate advertising performance.

Information may also be needed to address misuse, resolve disputes, and meet applicable legal or recordkeeping obligations. Transactional SMS, when available, is limited to the billing and account purposes described below and requires express opt-in consent.

5. Service providers, Viva platforms, and data sharing

Viva Start provides the client-intake entry point and links to Typeform intake forms. Information you submit through those forms is processed through Typeform. Viva Start also loads a Manus analytics resource.

Depending on the services used in your relationship with Viva, billing and payment information may be processed through QuickBooks or Stripe; business communications through Microsoft 365 / Outlook; and workflow information through Zapier. Twilio is the intended communications provider for the transactional SMS program described below. A platform's involvement depends on the services and integrations actually provided to you.

Where made available as part of your relationship with Viva, VivaOS supports client and operational management, and Viva Supply supports product requests, ordering, and customer accounts. Information handled through these platforms depends on the functions you use and information you supply. A mention in this policy does not mean that every platform or feature is available to every customer.

Customer information may be processed by service providers supporting the services you use. A provider's own privacy notice and terms may also apply to your direct use of its service. Information may be disclosed when required by applicable law or valid legal process. The additional restrictions on mobile information and SMS consent below apply to the SMS program.

6. Transactional SMS consent and preferences

You may provide optional consent to receive automated transactional text messages from Viva Design Co. at the phone number you provide about invoices, outstanding balances, payment reminders, and account notifications. Transactional SMS sending is not currently active. Providing consent records your permission and does not trigger an immediate message. These SMS terms apply when the program becomes available.

If you opt in, you may receive automated transactional text messages concerning invoices, outstanding balances, payment reminders, and account notifications. Message frequency varies. Message and data rates may apply. Consent is not a condition of purchase. Providing a phone number in a general inquiry form does not, by itself, enroll you in automated SMS.

SMS permission is separate from general website or service acceptance. Consent records may include your phone number, the time of consent, and the disclosure you accepted. These records relate to the specific Viva Design Co. messaging program you choose.

Mobile information, SMS opt-in information, and SMS consent are not sold or shared with third parties or affiliates for marketing or promotional purposes. Information needed to deliver or support requested messages may be processed by authorized communications service providers for those purposes, not for their independent marketing.

For the SMS program when available, reply STOP to opt out or HELP for assistance. You may also contact CustomerSupport@vivadesignco.com or +1 (505) 908-7053. See our Terms of Service for messaging terms.

7. Security and retention

No website, electronic transmission, or storage system can be guaranteed completely secure. Please take care when sharing information online and do not send sensitive credentials through general inquiry forms.

Retention depends on the information involved, the services provided, and applicable obligations. Information may need to be retained for an ongoing client relationship, accounting or legal requirements, or dispute resolution. A deletion request may not remove records that must be retained for a lawful reason.

8. Privacy requests and communication preferences

Contact CustomerSupport@vivadesignco.com to ask about your information, request access or correction, request deletion, or change communication preferences. Information reasonably necessary to verify your identity and understand the request may be needed. Please do not include unnecessary sensitive information in a request.

Your legal rights, available choices, and our response obligations depend on applicable law and circumstances. Some records may need to be retained for lawful reasons.

Declining or withdrawing SMS consent is not a condition of purchasing services. SMS preferences do not change payment obligations or replace communications required by a separately executed client agreement.

9. Policy updates

We may update this policy to reflect changes in services, technologies, or legal obligations. The date above identifies the latest revision. Notice of material changes will be provided where required by applicable law.
